These Terms of Service ("Terms") govern your use of the ISpy mobile application and website at https://ispy.top (collectively, the "Service"). By downloading, installing, or using ISpy, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Description of ISpy

ISpy is a mobile application available for iOS and Android devices that transforms your smartphone into a professional overhead camera for desk-view recording. The app features:

- Hands-free recording that starts automatically when you place your phone face-down
- Real-time angle correction and perspective flattening
- Adaptive lighting and flicker filters
- On-device video processing (no cloud uploads)
- Unlimited recording with no time limits or watermarks

2. Service Tiers

2.1 Free Version

The free version of ISpy includes:

- Unlimited 1080p @ 30fps recording
- All angle correction and perspective features
- Adaptive lighting and flicker filters
- Complete privacy with on-device processing
- No watermarks, advertisements, or time limits

2.2 Premium Version

The Premium version is available as a one-time purchase of $4.99 USD and includes:

- All Free version features
- 4K @ 30fps ultra-high-definition recording
- Lifetime access with no recurring fees or subscriptions
- Future updates and improvements at no additional cost

3. License and Usage Rights

3.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use ISpy for your personal or commercial use.

3.2 Permitted Uses

You may use ISpy to:

- Record videos for personal, educational, or commercial purposes
- Create content for social media, YouTube, or other platforms
- Produce educational or instructional materials
- Document work processes or creative projects

3.3 Prohibited Uses

You may NOT:

- Reverse engineer, decompile, or disassemble the app
- Remove or alter any copyright, trademark, or proprietary notices
- Use the app for any illegal purpose
- Share or resell your Premium license to others
- Attempt to circumvent any security or access control mechanisms
- Use the app to record others without their consent where such recording is illegal

4. Purchases and Payments

4.1 One-Time Purchase

The Premium upgrade is a one-time purchase. There are no recurring fees, subscriptions, or hidden charges. Once purchased, Premium features are yours permanently.

4.2 Payment Processing

Payments are processed through Apple App Store (iOS) or Google Play Store (Android). We do not directly process or store your payment information. Payment terms are subject to the respective app store's terms and conditions.

4.3 Pricing

Prices are in USD and may vary by region due to currency conversion and local taxes. The app store will display the final price before purchase.

4.4 Refunds

Refund requests must be made through the Apple App Store or Google Play Store according to their respective refund policies. Generally, refunds may be requested within 7 days of purchase if:

- The app fails to perform as described
- You experienced technical issues that prevent use of Premium features
- The purchase was made in error

5. Privacy and Data

5.1 On-Device Processing

ISpy does not track your usage, collect analytics, or monitor your behavior within the app.

6. Intellectual Property

6.1 App Ownership

You retain all rights to videos you create using ISpy. We claim no ownership over your recordings. Your videos belong entirely to you.

7. Disclaimers and Limitations

7.1 Service Availability

We strive to keep ISpy functional and bug-free, but we cannot guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind.

7.2 Recording Responsibility

You are solely responsible for:

- Ensuring you have the legal right to record content
- Obtaining necessary consents when recording others
- Complying with local laws regarding recording
- The content you create and how you use it

7.3 Device Compatibility

ISpy requires compatible iOS or Android devices. We cannot guarantee compatibility with all devices, operating system versions, or future updates.

7.4 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

- Loss of recordings due to device failure, user error, or other causes
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount you paid for Premium features

8. Updates and Changes

8.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. Updates may be required to continue using the app.

8.2 Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of the Service after changes constitutes acceptance of modified Terms. For significant changes, we will notify users via email.

We reserve the right to modify, suspend, or discontinue any aspect of the Service with or without notice. We will not be liable for any modification, suspension, or discontinuation.

9. Account Termination

You may stop using ISpy at any time by uninstalling the app from your device.

We may suspend or terminate your access to ISpy if you violate these Terms or engage in fraudulent activity.

9.3 Effect of Termination

Upon termination, your license to use ISpy ends immediately. However, Premium purchases cannot be revoked except through app store refund processes.

You are responsible for complying with all applicable laws regarding recording, including:

- Educational institution recording rules
- Privacy laws in your jurisdiction

10.2 Export Compliance

You agree not to export or re-export ISpy in violation of any export control laws.
